Terms of Service — Leischner Products

Welcome to Leischner Products. These Terms of Service (“Terms”) govern your access to and use of our website, products, services, and checkout (collectively, the “Services”). By visiting or purchasing from us, you agree to these Terms and to all policies referenced here, including our Privacy Policy and Return & Refund Policy.

If you do not agree, please do not use the Services.

  1. Eligibility and your account
  • Age: You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase. If you are under 18, you may use the Services only with involvement and consent of a parent or legal guardian.
  • Account: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
  • Accuracy: You agree to provide current, complete, and accurate information at checkout and to promptly update your information so we can complete your orders and contact you as needed.
  1. Products and availability
  • Range: We sell clothing, shoes, mugs/drinkware, electronics, and home decor. Availability, colors, materials, sizes, and specifications may change without notice. We attempt to display colors and features accurately but cannot guarantee your device’s display will be accurate.
  • Limited quantities: Products may have limited quantities and may be discontinued at any time. We may impose order limits per person, household, or order to prevent abuse or reselling.
  • Use and safety: For electronics, review all manufacturer documentation and safety instructions before use. You are responsible for backing up data and removing personal information before returning electronics.

  • Pricing: Prices are shown in USD unless otherwise noted and exclude taxes, duties, and shipping charges, which are calculated at checkout.
  • Taxes and duties: You are responsible for applicable sales taxes, VAT/GST, customs duties, and import fees, unless we state otherwise at checkout.
  • Errors: We may correct inaccuracies or errors (including pricing and availability) and change or update information at any time without prior notice. If a pricing error affects your order, we may cancel and refund, or contact you for instructions.
  1. Ordering and payment
  • Offer to purchase: Your order is an offer to buy. We may accept or reject any order in our sole discretion (for example, in cases of suspected fraud, pricing errors, or inventory issues).
  • Payment: We accept the payment methods shown at checkout. By submitting a payment method, you represent that you are authorized to use it and authorize us (and our payment processor) to charge the full order amount, including taxes, shipping, and any recurring charges if applicable.
  • Verification: We may require additional verification or information before accepting an order. If we cannot process or fulfill an order, we will cancel and refund any amount charged.
  1. Shipping, delivery, and risk of loss
  • Shipping: We ship to the locations shown at checkout. Estimated delivery dates are not guaranteed and may be affected by carrier delays or other factors outside our control.
  • Risk of loss/title: Title and risk of loss pass to you upon our delivery of the order to the carrier. Inspect packages upon delivery and report damage or missing items promptly.
  • International shipments: International customers are responsible for customs clearance and any associated fees, unless otherwise stated.
  1. Returns, exchanges, and refunds

  • Policy incorporated: Our Return & Refund Policy is incorporated into these Terms. Please review it before purchasing.

  • Defects/damage: If an item arrives damaged or defective, contact us promptly with photos and order details as described in our Return & Refund Policy.

  • Electronics: Electronics may have different return windows and requirements, including for unopened items and manufacturer warranty handling. See our Return & Refund Policy for details.

  1. Promotions, discount codes, bundles, and gifts
  • Promotions: Promotions and discount codes may be subject to additional terms. Unless stated, promotions are one per order, non-transferable, not redeemable for cash, and cannot be applied to taxes, shipping, or gift cards.
  • Bundles/BOGO: If you return part of a bundle, the refund may reflect the standalone price of kept items.
  • Gifts: Refunds for gifts generally go to the original payment method unless our Return & Refund Policy states otherwise.
  1. Subscriptions, pre-orders, and backorders (if offered)
  • Subscriptions: If we offer subscriptions, you authorize recurring charges until you cancel. We will disclose billing frequency and cancellation terms at signup. Cancel at least one business day before the next renewal to avoid being charged.
  • Pre-orders/backorders: Estimated shipping windows are subject to change. We may charge at time of order to reserve inventory.
  • Updates: We will notify you of material delays or changes where feasible.
  1. User content (reviews, photos, feedback)
  • License: If you submit reviews, photos, comments, or feedback, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, translate, distribute, and display such content in any media for marketing, analytics, and operations, without compensation to you.
  • Responsibility: You represent that you own or control all rights to your content, and that it does not infringe, defame, or violate any law. We may remove content we consider inappropriate, unlawful, or in violation of these Terms.
  • Feedback: We may use suggestions or feedback without restriction or obligation to you.
  1. Prohibited uses You agree not to:
  • Violate any law or regulation (including export controls and sanctions).
  • Infringe or violate others’ intellectual property or privacy rights.
  • Upload malicious code, interfere with the security or operation of the Services, or attempt to gain unauthorized access.
  • Misrepresent your identity or affiliation, or engage in fraud.
  • Use the Services for any abusive, harassing, or harmful activity.
  • Resell products purchased from us without our prior written consent.
  1. Intellectual property
  • Ownership: All content on the Services (including text, graphics, logos, product images, videos, and code) is owned by or licensed to Leischner Products and protected by intellectual property laws. Unauthorized use is prohibited.
  • Trademarks: Leischner Products and related logos are our trademarks or service marks. Other names may be trademarks of their respective owners.
  • DMCA/complaints: If you believe content infringes your rights, contact leischnerbusiness@gmail.com with “IP Complaint” in the subject line and include: your contact info, a description of the work, the URL(s), a statement under penalty of perjury that you have a good-faith belief the use is unauthorized, and your signature.

  • Third parties: The Services may link to third-party websites or integrate third-party tools (e.g., payment processors, shipping carriers). We do not control and are not responsible for third-party content, terms, or privacy practices.
  • Your dealings: Your use of third-party services is at your own risk and may be governed by those parties’ own terms and policies.

  • Electronic communications: By using the Services or emailing us, you consent to receive communications from us electronically (e.g., email, website notices).
  • SMS (if offered): By opting into SMS updates or marketing, you agree to receive texts to the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Consent is not a condition of purchase. Your opt-in is subject to our Privacy Policy and any SMS-specific disclosures at sign-up.
  1. Warranties and disclaimers
  • General: EXCEPT AS EXPRESSLY SET OUT IN WRITING, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
  • Product information: We do not warrant that product descriptions, images, or other content are error-free. Minor variations (e.g., color due to display settings) are not defects.
  • Electronics: For electronics, any manufacturer warranties apply as stated by the manufacturer. After our defect window, you may need to contact the manufacturer for support.
  • No guarantee: We do not guarantee uninterrupted, timely, secure, or error-free operation of the Services.
  1. Limitation of liability TO THE FULLEST EXTENT PERMITTED BY LAW, LEISCHNER PRODUCTS AND OUR OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, OR DATA; OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR, IF THE CLAIM RELATES TO SERVICE ACCESS, ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain limitations; in such cases, the above limits apply to the maximum extent permitted.

  1. Indemnification You agree to indemnify, defend, and hold harmless Leischner Products and our owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Services or products; (b) your violation of these Terms or applicable law; or (c) your infringement of any third-party right.

  2. Dispute resolution, arbitration, and class action waiver

  • Informal resolution first: Before filing a claim, you agree to try to resolve the dispute informally by emailing leischnerbusiness@gmail.com with a description of your claim. If not resolved within 30 days, either party may proceed as below.
  • Binding arbitration: To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product (collectively, “Disputes”) will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat and venue of arbitration will be Loudoun County, Virginia. The language will be English.
  • Exceptions: Either party may seek relief in small claims court for qualifying claims; and either party may seek injunctive or equitable relief in court to prevent actual or threatened infringement or misappropriation of intellectual property or confidential information.
  • Class action and jury waiver: You and we agree that Disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. You and we waive the right to a jury trial.
  • Fees and costs: Payment of AAA fees will be governed by AAA rules. Each party bears its own attorneys’ fees unless the arbitrator awards otherwise under applicable law.
  • Opt-out: You may opt out of this arbitration agreement within 30 days of your first purchase by emailing leischnerbusiness@gmail.com with subject line “Arbitration Opt-Out” and your name, order number, and a statement that you opt out. Opting out does not affect other provisions of these Terms.

  1. Governing law and venue These Terms are governed by the laws of the Commonwealth of Virginia and applicable U.S. federal law, without regard to conflict-of-laws rules. Subject to the arbitration clause, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Virginia for any disputes not subject to arbitration. Where consumer protection laws in your jurisdiction provide additional rights, those rights will prevail.

  2. Export and sanctions compliance You agree to comply with all U.S. and international export control and sanctions laws. You will not use, export, re-export, or transfer any products or Services in violation of such laws.

  3. Force majeure We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, strikes, labor disputes, wars, terrorism, epidemics, supply-chain disruptions, or failures of third-party networks or utilities.

  4. Changes to the Services or Terms We may update the Services and these Terms from time to time. Changes are effective when posted to the website with a new “Last updated” date. Your continued use after changes means you accept the updated Terms. If we make material changes to key policies affecting purchases (e.g., returns), we will provide notice where reasonable.

  5. Severability, waiver, and assignment If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity of the remaining provisions. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign these Terms as part of a merger, acquisition, or asset transfer.

  6. Entire agreement These Terms, together with any order confirmation, our Privacy Policy, and our Return & Refund Policy, constitute the entire agreement between you and Leischner Products regarding the Services and products and supersede any prior agreements or understandings.

  7. Notices and contact

Category-specific notes

  • Clothing and shoes: Use our size charts and care instructions; returns require items unworn, unwashed, and with tags per our Return & Refund Policy.
  • Mugs/drinkware: Check care instructions (e.g., dishwasher/microwave suitability) on each product page.
  • Electronics: Follow manufacturer instructions and local laws. Remove personal data and sign out of accounts before returns. Manufacturer warranties may apply.
